*OSUN 2022: CONGRATULATION OYETOLA , CONGRATULATION APC FAMILY*
There is no political miracle or constitutional miracle that will make them swear in Adeleke of the People Democratic Party as the next governor of Osun state. FROM the basic reality on ground at the osun state governorship election tribunal where the counsel of the PDP admitted that there was over voting in 749 units and he prayed and plead that the additional votes should be subtracted instead of cancellation of the total unit result.
But before i go further with this common sense analysis, let see what the constitution says about situation of over voting in an election
Section 51 (2) Of The Electoral Act 2022 Says
*”Where The Number Of Votes Cast At An Election In Any Polling Unit Exceeds The Number Of Accredited Voters In That Polling Unit, The Presiding Officer Shall Cancel The Result Of The Election In That Polling Unit”*
The constitution is supreme, hence the election in those affected polling units will and shall be cancelled .And if that happens at the tribunal, two things are bound to happen, is either oyetoola of the APC Will be leading with a wide margin and hence will be declared winner and return elected as the gov. of osun state or the election will be declared inconclusive if the number of the cancelled votes is more than the margin of victory at the election and hence a re run will be ordered.any way it goes it is a WIN WIN situation for OYETOLA and APC.
PDP and there counsel has sat down and made the necessary political arithmetic and have seen that the are at the loosing point hence there plea for subtraction of votes instead of cancellation of the entire polling unit result
But come to think about it, if the votes are to be substracted which of the parties votes will be substracted and will bear the burden of such act of subtraction ,since over 5 political parties participated in the election. So the only best common senses and constitutional approach is to cancel all the results of the affected polling unit , and that the constitutional provision and must be followed and respected
Conclusively .i wonder what type of political party is PDP,the brought ballot box snatching when it was manual voting, now the have started introducing over voting electronically. THANK God we APC are wiser and equal to there rigging Antics.
